The recently published Safety, Health & Welfare at Work Bill 2004 introduced some significant changes to existing legislation:

  • Expanded general duty on employers, including a duty to manage work activities so as not to endanger any person, directly employed or sub-contracted by you or any member of the public.
  • Failure to comply can now result in a six-month prison sentence and a maximum fine of €3million. On the spot fines of €1,000 are also possible.
  • Stress and bullying are new duties of care.
  • Safety Statements and Risk Assessments must be in writing and periodically reviewed.
  • Training Programmes for employees must be undertaken, where specified.
  • Appointment of a Rights Commission to lessen disputes relating to Health & Safety
